Coleman v. Commonwealth

Facts:

Defendant was convicted in the Virginia Beach General District Court (Virginia) for driving under the influence of alcohol (DUI) in violation of Va. Code Ann. § 18.2-266. On a de novo appeal, he filed a motion to dismiss the charge and a motion to declare parts of Va. Code Ann. §§ 18.2-269 and 18.2-270 unconstitutional.

Holdings:

The Virginia Court made the following holding:

  • Va. Code Ann. § 18.2-266(i) implies that where a blood alcohol test is administered and a reading of 0.08 or more is revealed, the accused is presumed to have been legally intoxicated at the time of the test and also at the time of the offense. Both Va. Code §§ 18.2-266(i) and 18.2-269(A)(3) essentially state the same thing: if a properly administered test indicated a blood alcohol level of 0.08 percent or more, the accused is presumed to have been legally intoxicated at the time of the test and is presumed to have been legally intoxicated during the commission of the offense.
